GENERAL CONDITIONS OF USE OF PHOTOGRAPHS SHOWN
ON THE GROUPE BEL PHOTOGRAPHIC LIBRARY WEBSITE

ARTICLE 1: OBJECT

The aim of the General Conditions set out herein is to stipulate and define the conditions under which the various entities of Groupe Bel, of which Fromageries Bel is the head company, together with certain authorised third parties (hereinafter referred to as the ‘Users’, shall be allowed to use the photographs (hereinafter referred to as the ‘Photographs’) on the Groupe Bel photographic library website (hereinafter referred to as the ‘Website’).

It is hereby clarified that upon using the Photographs on the Website, the User undertakes to completely abide by the General Conditions of Use set out herein and accepts all the respective stipulations without any reserves whatsoever. Fromageries Bel reserves the right to modify the said General Conditions of Use at any time.

ARTICLE 2: PURPOSES OF THE USE OF THE PHOTOGRAPHS

Any photograph on the Website shall be used solely for the purpose of illustrating internal or external publications, presentation brochures, reports, etc., concerning Groupe Bel, strictly within the framework applying to professional use.

It is expressly stipulated that the use of any Photograph on the Website for commercial and/or advertising purposes is prohibited.

ARTICLE 3: AUTHORISATION

A User may only use a Photograph on the Website if Fromageries Bel has issued express and written agreement concerning such use.

A Photograph may only be used by a User for a purpose previously and expressly accepted by Fromageries Bel, and such acceptance is understood to apply to use on one occasion only.

Any reuse is prohibited unless Fromageries Bel grants prior, express and written agreement to the contrary.

ARTICLE 4: SCOPE OF GRANTED RIGHTS OF USE

The User is solely and exclusively authorised to reproduce and/or represent one or several Photograph/s shown on the Website, with this being applicable subject to the General Conditions of Use set out herein.

Therefore, the User holds no rights pertaining to the adaptation, and in particular the modification, re-centring, addition or removal of the Photographs on the Website.

However, the User is not subject to any restriction whatsoever concerning the number of copies made of the material or medium used for the reproduction and/or representation of the Photographs.

It is hereby clarified that under no circumstances shall the User transfer, either in return for payment or at no cost, any right whatsoever applying to one or several Photograph/s on the Website.

It is hereby clarified that the Photographs on the Website are creative works protected by the Intellectual Property Code and belong fully and entirely to Fromageries Bel, or, if the case arises, to any other entity within Groupe Bel.

ARTICLE 5: DURATION

The use of the Photographs shown on the Website may be restricted to a certain period of time. In such a case, the final date for use shall be specified on the descriptive sheet accompanying each Photograph.

The User shall personally take all steps as necessary to prevent any Photograph on the Website from being used, published or circulated or to prevent it from remaining in circulation following expiry of the final date for right of use, where the latter has been stipulated.

Moreover, at any time whatsoever, Fromageries Bel may withdraw the right of use granted to the User, with this being applicable even prior to the expiry date for the right of use if the descriptive sheet specifies such a date and particularly if the author of one or several Photograph(s) shown on the Website chooses to assert his/her right to change his/her original decision as provided for in Article L.121-4 of the Intellectual Property Code.

ARTICLE 6: COPYRIGHT

Subject to any other different stipulated observation(s) set out if the case arises on the descriptive sheet accompanying each Photograph, the following observations must be appear legibly at the side of – or on – the Photograph represented and/or reproduced:

© Fromageries Bel, [followed by the name of the photographer if the case arises]

It is hereby clarified that if the case arises, the name of the photographer is stated on the descriptive sheet accompanying each Photograph.

ARTICLE 7: WRITTEN PROOF

In the event that a User arranges to publish a Photograph, he/she must then forward written confirmation thereof to Fromageries Bel, addressing such correspondence as follows:

ARTICLE 8: LIABILITY

The User shall be fully liable for the consequences of any use that infringes the General Conditions of Use set out herein, as applying to one or several Photograph(s) on the Website.

ARTICLE 9: APPLICABLE LAW AND GRANTING OF JURISDICTION

The General Conditions set out herein are governed solely by French law.

Any lawsuit arising concerning the interpretation or implementation of the General Conditions set out herein shall be submitted to the competent Courts of Paris, to the exclusion of all other courts of law.
